3. Cancellation Policy

3.1 Project Planning Phase

Full Refund Available: If you cancel during the project planning and requirement gathering phase (before active development begins), you are eligible for a 100% refund of any advance payments made.

3.2 Active Development Phase

Partial Refund: Once development work has commenced, refunds will be calculated based on work completed. You will be charged for the work already completed plus any non-recoverable costs incurred.

3.3 Project Completion Phase

No Refund: Once a project is 75% complete or delivered, no refunds will be provided. However, we will work with you to address any concerns or issues with the delivered solution.

4. Refund Eligibility

4.1 Eligible Situations

Refunds may be considered in the following situations:

  • Project cancellation during the planning phase
  • Material breach of contract by Birla
  • Failure to deliver agreed-upon functionality within reasonable timeframes
  • Technical impossibility of project completion as originally scoped
  • Mutual agreement to terminate the project

4.2 Non-Eligible Situations

Refunds will not be provided in the following cases:

  • Change of mind after project commencement
  • Client's inability to provide required materials or feedback
  • Delays caused by client-side factors
  • Changes in client's business requirements after project approval
  • Dissatisfaction with delivered work that meets agreed specifications
  • Third-party service failures beyond our control

5. Refund Process

5.1 How to Request a Refund

  2. Include your project details, invoice number, and reason for refund request
  3. Provide any supporting documentation or evidence
  4. Allow up to 5 business days for initial response

5.2 Refund Timeline

Review Period

5-7 business days for refund request review and approval

Processing Time

7-14 business days for refund processing and transfer

Bank Processing

3-5 additional business days for bank processing

6. Refund Methods

Approved refunds will be processed using the following methods:

  • Bank Transfer: Refunds will be transferred to the original bank account used for payment
  • Original Payment Method: Where possible, refunds will be credited to the original payment method
  • Processing Fees: Payment processing fees (typically 2-3%) may be deducted from refund amounts
  • Currency: Refunds will be processed in the same currency as the original payment

7. Partial Refund Calculation

When partial refunds are applicable, Birla uses the following calculation method:

Refund Amount = Total Project Cost - (Completed Work % × Total Cost) - Non-Recoverable Expenses

Completed Work %: Assessed based on project milestones achieved

Non-Recoverable Expenses: Third-party licenses, hosting setup, domain purchases, etc.

8. Special Circumstances

8.1 Emergency Situations

In case of genuine emergencies (medical, financial hardship, force majeure events), Birla may consider special accommodations on a case-by-case basis.

8.2 Subscription Services

For ongoing subscription services, cancellations can be made at any time with 30 days notice. No refunds will be provided for unused portions of prepaid subscription periods.

8.3 Maintenance and Support

Maintenance and support services are non-refundable once the service period begins. However, unused portions may be credited toward future services.

9. Dispute Resolution

If you are not satisfied with our refund decision, you may escalate the matter through the following steps:

  1. Request a review by senior management
  2. Engage in mediation if mutually agreed upon
  3. Pursue resolution through appropriate legal channels if necessary

10. Modifications to This Policy

Birla reserves the right to modify this Refund and Cancellation Policy at any time. Changes will be effective immediately upon posting on our website. Existing projects will be governed by the policy in effect at the time of project commencement.
